Data transfer has been one of the hot topics of the last 10 years.
On Thursday the ECJ is expected to hand down its judgment in Schrems III. The case could have far-reaching effects for data transfer and in particular for Standard Contractual Clauses (SCCs) and Privacy Shield.
As many of you will know André has followed the case since its inception and he brings a unique perspective to these issues having worked at the ECJ and in Brussels. I’ve also followed the case from the earliest times and interviewed Max Schrems on the litigation in Paris in 2016 when we talked about the chances of Privacy Shield surviving. Of course there’s no guarantee that the court will follow the Attorney-General’s opinion – the court didn’t do this in Schrems I.
