In the latest episode of Life with GDPR Cordery’s Jonathan Armstrong discusses data transfer with Tom Fox. With different judgments on the horizon, Jonathan talks about the proposed replacement for Safe Harbor and Privacy Shield, the Data Privacy Framework (DPF) and how he thinks it will likely fail. Jonathan feels that it is “doomed inevitably to failure”. He also talks about the European Data Protection Board (EDPB) investigation into Google and Facebook and the so-called 101 Complaints. These are issues that might affect up to 95% of US firms who use Google Analytics. How can your company comply with GDPR requirements? How can you transfer data lawfully from the EU? Since the podcast was recorded one of Jonathan’s predictions seems to have come true at the European Parliament also expressed their concerns about DPF on 11 May 2023 and also felt that DPF would not be guaranteed to survive a court challenge.
